An employee who is not delivering, or is off sick all the time, or is not a culture fit, has an undeniable impact on an organisation and team morale. Avoidance of the situation by management, is not an option. But - the situation must be handled appropriately and fairly by the employer, and if a formal process is instituted that may lead to dismissal, this must conform to the guidelines in the Code of Good Practice: Dismissal to the Labour Relations Act (which has been updated in September 2025).
This workshop unpacks all the fairness considerations, strategies and practical steps to take, for the different types of Incapacity.
